“If we do a good job preventing workplace injuries, we can spend less time on the work of returning injured workers to the workplace,” said Gina Vahlas, prevention field services manager with WorkSafeBC, during the Workplace Injury Virtual Summit on Jan. 30. The event, presented by Talent Canada and OHS Canada, drew more than 500 attendees from across the country to explore strategies for preventing injuries and supporting injured workers during their recovery and return to work.

When it has been alleged that an employee engaged in wilful misconduct, it is best practice for an employer to conduct a thorough investigation and provide the employee with the opportunity to know of and respond to the allegations. That is what would be considered “procedural fairness.” However, a recent Ontario case held that the Employment Standards Act of Ontario did not impose a duty of procedural fairness upon an employer when terminating an employee for wilful misconduct.
