When an employee brings a wrongful dismissal claim against their former employer, that employee has a legal duty to mitigate their damages by making reasonable efforts to find comparable work. If an employer suspects that the employee is failing to fulfil their obligation to mitigate damages, they can take the position that any damages awarded to the employee for wrongful dismissal should be reduced due to the employee’s failure to mitigate. However, in most situations, it can be very difficult for employers to successfully argue that a former employee has failed to mitigate their damages.
